Terms of Service

These Terms of Service ("Terms") govern your use of Fat Agents ("Service"), operated by Alex Garcia ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Service Description

Fat Agents provides AI-powered agent hosting. You can create AI agents that respond to emails and Slack messages on your behalf. We provide the infrastructure; you provide the API keys and configuration.

2. Account Requirements

You must be 18 years or older to use the Service
You must provide accurate account information
You are responsible for maintaining the security of your account credentials
You are responsible for all activity that occurs under your account

3. Your Responsibilities

You are responsible for:

All content your agent generates or processes
Ensuring your use complies with applicable laws
Any API keys you provide (Anthropic, Slack, etc.)
The actions your agent takes on your behalf
Complying with our Acceptable Use Policy

4. BYOK (Bring Your Own Key)

You may provide your own Anthropic API key. When you do:

We store your key encrypted at rest
Your key is only used to power your agent
You are responsible for any charges from Anthropic
We are not responsible for API key misuse if your account is compromised

5. Payment Terms

Subscription fees are billed monthly in advance
All fees are non-refundable except as required by law
Failed payments may result in service suspension

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind. We are not liable for:

Downtime or service interruptions
Data loss (though we take reasonable precautions)
Actions taken by your AI agent
Third-party service failures (Anthropic, Slack, etc.)

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

We store agent configuration and logs
Email and message content passes through our systems
We do not sell your data
You can delete your account and data at any time

8. Intellectual Property

You retain ownership of your content and configurations
We retain ownership of the Service and its underlying technology
You grant us a license to process your content to provide the Service

9. Termination

You may cancel your subscription at any time
We may suspend or terminate accounts that violate these Terms
Upon termination, your agent will stop running and data will be deleted after 30 days

10. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions.

12. Changes to Terms

We may update these Terms. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
